Terms of Service

The short version. By using GiFit - you agree to these terms. Subscriptions are billed by Apple - auto-renew monthly or annually unless canceled - and can be canceled anytime in your Apple ID settings. GiFit gives general fitness information - not medical advice. Always consult a physician before starting a new exercise or nutrition program. You are responsible for using the app safely. The full terms are below.

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your use of the GiFit mobile application ("GiFit" - "the app" - "we" - "us" - or "our") - operated by Streamlined Processes LLC - an Oklahoma limited liability company.

By downloading - installing - accessing - or using GiFit - you agree to be bound by these Terms. If you do not agree - do not use the app.

2. The Service

GiFit is a self-paced fitness application that provides:

GiFit is intended for general fitness and wellness purposes only. It is not a medical device and is not intended to diagnose - treat - cure - or prevent any disease.

3. Eligibility

You must be at least 13 years old to use GiFit. If you are between 13 and 18 - you may use the app only with the permission and supervision of a parent or guardian who agrees to be bound by these Terms.

4. License to Use the App

We grant you a limited - non-exclusive - non-transferable - revocable license to install and use the GiFit app on Apple devices you own or control - solely for your personal - non-commercial use - subject to these Terms and Apple's App Store Terms of Service.

5. Subscriptions and Purchases

GiFit offers a free tier and a paid "GiFit Pro" subscription. Pricing and tiers as of the effective date:

Auto-renewal

Monthly and annual subscriptions automatically renew at the end of each billing period at the then-current price unless canceled at least 24 hours before the end of the current period. Your iTunes Account will be charged for renewal within 24 hours before the end of the current period.

Cancellation

You can cancel your subscription at any time by managing your subscriptions in your iTunes Account settings:

Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that date.

Refunds

All subscription transactions are processed by Apple - and Apple is responsible for all refund decisions. GiFit cannot directly issue refunds for subscriptions purchased through the App Store. To request a refund - visit reportaproblem.apple.com or contact Apple Support.

Free trials and promotional pricing

If a free trial or promotional rate is offered - any unused portion of the trial period is forfeited when you purchase a subscription. Promotional pricing applies only to the initial period and reverts to standard pricing at renewal unless stated otherwise.

Price changes

We may change subscription pricing for new subscribers at any time. Existing subscribers will retain their current pricing through the end of their current billing period. If we increase the price applicable to your renewal - we will notify you in advance and you may cancel before renewal if you do not wish to continue.

IMPORTANT. GiFit provides general fitness and nutrition information for educational and informational purposes only. It is not - and should not be construed as - medical advice - diagnosis - or treatment.

Before beginning any new exercise program - nutrition plan - or supplement regimen - you should consult a qualified healthcare professional - especially if you have any of the following:

Stop any exercise that causes pain - dizziness - shortness of breath - or other unusual symptoms - and consult a medical professional. By using GiFit - you assume all risk associated with the exercises - nutrition recommendations - and supplement information provided. Individual results vary. GiFit makes no guarantees about specific outcomes.

8. User Content

You retain ownership of any content you provide to the app - including your profile photo - custom workouts - and notes. By providing such content - you grant Streamlined Processes LLC a limited license to store and use that content solely for the purpose of operating the app for you.

We do not display - share - or use your personal content for any other purpose.

9. Intellectual Property

The GiFit app - including all text - images - GIFs - logos - branding - programs - recipes - supplement library content - design - and code - is the property of Streamlined Processes LLC or its licensors - and is protected by United States and international copyright - trademark - and intellectual property law.

10. Third-Party Services

GiFit uses certain third-party services to function - including Apple - RevenueCat - Bunny CDN - and Cloudflare. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of these third parties.

11. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind - either express or implied. To the fullest extent permitted by law - Streamlined Processes LLC disclaims all warranties - including but not limited to implied warranties of merchantability - fitness for a particular purpose - and non-infringement.

We do not warrant that the app will be uninterrupted - error-free - secure - or free of viruses or other harmful components. We make no warranties regarding the results you may obtain from using the app.

12. Limitation of Liability

To the maximum extent permitted by law - in no event shall Streamlined Processes LLC - its members - officers - employees - or agents be liable for any indirect - incidental - special - consequential - exemplary - or punitive damages - including but not limited to damages for personal injury - lost profits - lost data - or other intangible losses arising out of or related to your use of the app - even if advised of the possibility of such damages.

Our total liability for any claim arising out of or related to these Terms or the app will not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim - or $100 USD - whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Streamlined Processes LLC - its members - employees - and affiliates from any claims - damages - losses - liabilities - and expenses (including reasonable attorneys' fees) arising out of or related to your use of the app - your violation of these Terms - or your violation of any rights of another party.

14. Termination

You may stop using GiFit at any time by uninstalling the app. We may suspend or terminate your access to the app at any time - with or without notice - if you violate these Terms or use the app in a way that could cause harm to us - other users - or third parties.

Termination does not entitle you to a refund of any unused subscription period - except as required by applicable law or by Apple's refund policies.

15. Governing Law

These Terms are governed by the laws of the State of Oklahoma - without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the app shall be resolved in the state or federal courts located in Tulsa County - Oklahoma - and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. When we make changes - we will update the "Last Updated" date above. If we make material changes - we will provide notice through the app or by email if you have contacted us. Your continued use of the app after changes are posted means you accept the updated Terms.
